Acceptance of Terms
These Terms of Service constitute a legally binding agreement between you ("Client") and Monk Funnel, operated by Manish Thakare, based in Delhi, India ("Agency", "we", "us"). By engaging our services, submitting a contact form, signing a proposal, or making any payment, you confirm that you have read, understood, and agree to be bound by these Terms.
By hiring Monk Funnel — whether via a signed proposal, a WhatsApp confirmation, or a payment — you agree to these terms. We recommend reading them fully before we begin work.
Scope of Work
Monk Funnel provides digital marketing services including SEO, Meta Ads, Google Ads, Social Media Marketing, Sales Funnel design, and Website Design & Development. The specific scope will be agreed in writing before commencement. Any work outside agreed scope will be treated as a new engagement and priced separately.
- Retainer Services: Monthly recurring services governed by the scope in the signed retainer agreement.
- Project-Based Services: One-time deliverables with clearly defined scope, timeline, and payment milestones.
- Audit Services: Standalone analysis and recommendations. Growth Audits (₹999) are non-retainer one-time services.
- Scope Changes: Any changes to agreed scope require written approval and may incur additional fees.
Your Responsibilities
- Provide Access: Grant timely access to ad accounts, analytics, website, social media, and other platforms necessary for service delivery.
- Provide Materials: Supply required assets (brand guidelines, images, product info, copy) by agreed deadlines.
- Timely Feedback: Respond to requests for approval or information within 3 business days. Delays may push delivery timelines proportionally.
- Accurate Information: Ensure all information provided is accurate and up-to-date.
- Lawful Use: Ensure all products, services, and content you ask us to promote comply with applicable laws.
- Ad Spend Budget: Ad spend is separate from our management fee and is your direct responsibility to fund in your ad accounts.
Fees & Payments
- Retainer Fees: Invoiced on the 1st of each month, payable within 7 days.
- Project Fees: Typically 50% upfront and 50% upon delivery, unless otherwise agreed in writing.
- Payment Methods: UPI, bank transfer (NEFT/IMPS), or Razorpay. All amounts in Indian Rupees (₹).
- Late Payment: Invoices unpaid beyond 14 days accrue a late fee of 2% per month. Services may be paused until settled.
- GST: All fees are exclusive of GST (18%), added to invoices as applicable under Indian tax law.
- Price Changes: 30 days' written notice before any price changes for existing retainer clients.
Ad spend on Meta, Google, or other platforms is NOT included in our management fees. You are billed directly by the respective platforms from your own account.
Ownership of Work
Upon receipt of full and final payment, all custom creative work produced exclusively for you transfers to you as the Client.
- Agency IP: Our proprietary methodologies, frameworks, templates, systems, and tools remain our intellectual property.
- Third-Party Assets: Stock images, licensed fonts, or third-party tools remain subject to their respective licences.
- Portfolio Rights: We reserve the right to use completed work in our portfolio and case studies unless you request otherwise in writing.
- Unpaid Work: No intellectual property rights transfer for work that has not been fully paid for.
Protecting Your Information
Both parties agree to keep confidential any proprietary, sensitive, or non-public information shared during the engagement, including business strategies, financial data, customer lists, and technical information.
- Confidential information will not be disclosed to third parties without prior written consent, except as required by law.
- Freelancers or contractors we engage will be bound by equivalent confidentiality obligations.
- This confidentiality obligation survives termination for a period of 2 years.
Limits of Responsibility
- No Guaranteed Results: Unless explicitly stated in a performance-based agreement, we do not guarantee specific outcomes such as a defined number of leads, a specific ROAS, or a target revenue figure.
- Maximum Liability: Our total liability shall not exceed the total fees paid to us in the 3 months preceding the claim.
- No Consequential Damages: We are not liable for indirect, incidental, or consequential damages including lost profits or business interruption.
- Platform Changes: We are not liable for changes to Meta, Google, or other platform policies that affect campaign performance.
Ending the Engagement
- By Client: You may terminate a retainer with 30 days' written notice. All fees for the current billing cycle remain due.
- By Monk Funnel: We may terminate with 30 days' notice for any reason, or immediately if you breach these Terms, fail to pay, or engage in unlawful activity.
- Project Work: The upfront deposit is non-refundable if you cancel after work has commenced.
- Upon Termination: We will provide all completed work and return access to your accounts within 7 business days of the final invoice being settled.
What We Promise
- Services will be delivered with reasonable skill and care in accordance with industry standards.
- We have the right to provide the services and will not knowingly infringe any third-party intellectual property rights.
- All work delivered will be original or properly licensed.
Services are provided "as is" with respect to outcomes. We make no warranty that campaigns will achieve specific business results beyond what is described in performance-based agreements.
Jurisdiction & Disputes
These Terms are governed by the laws of India. Any disputes shall first be attempted through good-faith negotiation. If negotiation fails, disputes will be subject to the exclusive jurisdiction of the courts of Delhi, India.

Our Refund Philosophy
At Monk Funnel, we are committed to delivering high-quality marketing services. We invest significant time, expertise, and resources into every engagement from the moment work begins. Because our services are knowledge-based and time-intensive, our refund policy reflects the nature of the work delivered.
If you are ever unsatisfied, contact us first. We are committed to resolving issues, revising deliverables, and ensuring you receive the value you paid for before any refund discussion becomes necessary.
Monthly Retainers
- No Mid-Cycle Refunds: Retainer fees are non-refundable once a billing cycle has commenced and work has begun.
- Cancellation: Cancel future retainer cycles with 30 days' written notice. No refund for the current cycle; no further charges after notice.
- Non-Commencement: If we have not yet started work for a paid cycle, a full refund can be issued within 48 hours of payment upon written request.
- Service Failure: If Monk Funnel fails to deliver agreed services without valid reason, a pro-rated refund for undelivered work may be issued at our discretion after review.
One-Time Projects
- Upfront Deposit (50%): Non-refundable as it covers discovery, research, strategy, and initial production that begins immediately.
- Milestone Payments: Non-refundable once that milestone has been delivered and approved.
- Client Cancellation: If you cancel after work has commenced, you are liable for fees proportional to the work completed at time of cancellation.
- Final Payment: Due upon delivery. Withholding final payment without written objections within 5 business days of delivery is not permitted.
All project packages include a specified number of revision rounds. Revisions within scope do not entitle you to a refund after revisions are exhausted.
₹999 Audits
- Non-Refundable After Delivery: Audit fees are non-refundable once the audit has been delivered to you.
- Pre-Start Cancellation: If you request cancellation before we have started the audit, a full refund will be issued within 5 business days.
- Quality Concern: If you believe the audit was not delivered as described, raise your concern within 48 hours. We will review and re-deliver or issue a refund at our discretion.
Advertising Budgets
- Advertising spend paid directly to Meta, Google, or other platforms is entirely separate from Monk Funnel's management fees.
- Monk Funnel does not collect or hold advertising budgets on your behalf.
- Monk Funnel has no authority to refund ad spend charged by Google, Meta, or any other platform.
- Our management fee is charged regardless of ad spend performance, as it covers strategy, setup, and optimisation time.
Special Circumstances
- Monk Funnel Error: If a refund is warranted due to a clear error on our part, we will issue it promptly without excessive justification required from you.
- Personal Emergency: We will work with you compassionately and may pause or reschedule services in lieu of a refund.
- Force Majeure: In events beyond reasonable control, we will work to reschedule or restructure the engagement rather than issue refunds.

- Include your invoice number, service description, and a clear explanation of your reason.
- We will acknowledge within 2 business days and provide a decision within 7 business days.
